TERMS & CONDITIONS and Disclaimer

This terms & conditions (“Terms & Conditions”) establish the terms and conditions which shall govern the customers (“You” or “Your”) availment of the services (a list whereof is annexed hereto at Annexure A) (“Services”) from Blueverse Washing LLC having its registered office at GS 032, AULP Building, Dubai, UAE with Makani No: 24393 81831 (“Company” or “We” or “Us” or “Our”) through (i) its website i.e. www.blueverse.ae and other technology based application (collectively referred to as the “Platform”) and (ii) its service centre(s) (a list whereof is annexed hereto as Annexure B) (“Service Centre(s)”). By accessing and using the Platform or registering on the Platform or availment of the Services, You agree to be fully and unconditionally bound by these Terms & Conditions. If You do not accept these Terms & Conditions, You are advised to not use the Platform and the Services. This Terms & Conditions shall at all times be read with the Privacy Policy annexed hereto as Annexure C. 

Eligibility:

You agree and confirm that (i) You are 21 years of age or above; (ii) You are legally competent to enter into a binding contract under the applicable laws of UAE; and (iii) You are the registered owner of the vehicle in relation to which the Services are sought (“Vehicle”)/ You are authorised by the registered owner of the Vehicle to avail the Services from Us.

Booking:

You can either pre-book the Services from our Platform and visit one of Our Service Centre(s) on the scheduled date and time or walk in one of our Service Centre (s) and book the Services there. We reserve the right to cancel or restrict the bookings due to technical failures/maintenance of the machines, weather disruptions, power/water outages or force majeure events or other reasons beyond the control of the Company. In case of such cancellation/ restriction, You will be offered a rescheduled service or refund/credit (as applicable) at the sole discretion of the Company.

Prices & Payment:

The prices are listed on the Platform. However, if You walk in one of our Service Centre(s), Our staff will intimate You of the prices applicable against each Service. All payments need to be made in advance. All the paid fees are non-refundable, unless otherwise decided by the Company at its sole and absolute discretion. Any discount or other consideration to some or all of our customers is at our sole and absolute discretion and in accordance with the applicable laws.

You agree to adhere to the terms and conditions and the privacy policies of the third-party payment service providers. In the event, We do not receive payment from You for any reason, including but not limited to card expiration, non-sufficient funds or declined charge, the Services will be placed on hold and You will not be able to avail our Services until the payment issue is resolved.

 Prior Disclosures

You must prior to the provision of the Services, disclose to Us all the defects or damages in the Vehicle, known or suspected by You. Moreover, if there are specific areas of the Vehicle that You do not wish to be cleaned or detailed, You should inform Us prior to the commencement of the Service. If We or Our staff have additional requests and/or instructions, You should abide by those requests and instructions, in order to receive the Services.

Valuables & Belongings:

It shall be Your responsibility to remove all Your valuables and belongings before handing over the Vehicle to Our staff and the Company (including all its directors, staff, employees, agents and representatives) disclaims all liabilities for missing items. You should clear out items from the centre consoles that might obstruct the cleaning process. Further, We shall not be liable to accept valuables or other articles for safe keeping and We shall not be responsible for loss or damage to such valuables or articles which You purport to leave in Our safe keeping. It shall be to your sole account to ensure that no items are left unattended in the Vehicle or at our Service Centre at the time of handover to perform the Services. Any purported claim by You of us having lost, misplaced or stolen any of your items shall be deemed duly contested by us and shall not be deemed admitted unless otherwise so directed by a court of competent jurisdiction.

Liability:

We will perform the Services as booked by You with reasonable skill and care and shall take all reasonable steps to ensure that Our representatives shall take reasonable care of the Vehicle while it is in Our custody, however We shall not be held liable for:

1. Damage to Vehicle or Loss of Vehicle or parts of it or accessories or contents therein due to reasons beyond Our control including but not limited to failure of the machines used for provision of the Services;
2. Damage caused resulting from or in connection with seizure of the Vehicle by police, other governmental authorities or other persons lawfully authorized to do so.

We, Our shareholders, directors, officers, employees, staff and agents, do not represent or guarantee that the Vehicle will be completely clean. Our Services do not include removal of excessive stains, deep upholstery cleaning, any repairs, steam cleaning the carpeting or the interior seating, or cleaning trunk spaces.  Further, We, Our shareholders, directors, officers, employees, staff and agents, disclaim all liabilities and You shall hold Us, Our shareholders, directors, officers, employees and agents, harmless from, any remaining dirt, debris or imperfections left in the Vehicle following the Services.

Insurance:

You shall at all times be responsible for procurement of insurance of the Vehicle and We do not undertake to insure the Vehicle against loss while it is in Our possession, subject to the provisions of the paragraph below. You shall be liable to Us for the death, injuries or damages suffered by Us or Our staff or Our properties installed at the Service Centre(s) attributable to defects in the Vehicle or harmful contents therein.

The Company has procured a third-party liability insurance policy. In the event any damage is caused to Your Vehicle while it is in Our possession, it will be covered under the said third-party liability insurance policy subject to the terms and conditions contained therein.

Refusal of Provision of Services:

The Vehicle must be in a condition suitable for cleaning. We reserve the right in Our sole judgment, to refuse Service for any reason. This includes but is not limited to: (i) the presence of weapons of any kind; (ii) unsecured or open hazardous chemicals in the Vehicle; (iii) presence of bodily fluids or waste; (iv) presence of drugs and drug paraphernalia; (v) bad smelling odours; (vi) excessive clutter in a vehicle; (vii) presence of conditions that pose a health or safety risk to Our staff; and (vii) presence of any substance that may be deemed illegal as per our sole discretion.

Additional Covenants:

1. You understand and accept that old or non-original paint work can be damaged during provision of the Services. All such defects shall be indicated to Our staff prior to provision of the Services;
2. You shall inform Our staff in advance of any special (including operational) feature attached to the Vehicle which may be deemed out of the ordinary in our discretion to ensure compliance thereof;
3. The child seats & the booster seats must be refitted by You and We will not be able to refit such seats under no circumstances;
4. You confirm that You have a spare set of keys for the Vehicle & that We shall not be liable for loss or damage caused to You or the Vehicle by reason of Us losing the keys or locking them in the Vehicle;
5. No complaints in relation to the Services will be entertained once You depart from the Service Centre (s).

Indemnification:

You will indemnify, defend, and hold harmless the Company and its shareholders, directors, officers, employees, staff and agents from and against all losses, claims, liabilities, demands, complaints, actions, damages, judgments, settlements, fines, penalties, expenses, and costs (including without limitation reasonable attorneys’ fees) that arise out of or in connection with Your breach of this Terms & Conditions.

Limitation of Liability:

IN NO EVENT WILL WE OR OUR SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES, STAFF OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO AED 10.

Modifications and Interruptions:

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at Our sole discretion without notice. However, We have no obligation to update any information on the Services. We also reserve the right to modify or discontinue all or part of the Services without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services. We cannot guarantee the Services will be available at all times. We may experience hardware, software, technical, or other problems or need to perform maintenance related to the Services, resulting in interruptions, delays, or errors. You agree that We have no liability whatsoever for any loss, damage, or inconvenience caused by Your inability to access or use the Services during any downtime or discontinuance of the Services.

Membership/Subscription:

We also offer a ‘membership/subscription’ model, wherein, the member/subscriber is entitled to a fixed number of washes for each registered Vehicle for a 1 (one) month period from the date of becoming a member/subscriber. You understand that by becoming a member/subscriber, Your credit card (which is registered with Us) will be charged on the respective billing date each month, until cancellation.

The membership/subscription can be cancelled, either by coming to one of our Service Centres and proving Your identification or by sending a message on WhatsApp from the registered mobile number or by sending an email to us at info@blueverse.ae. The cancellation request shall be made at least 5 (five) days prior to the expiration of the current billing month and in the event, the cancellation request is made when 5 (five) or less than 5 (five) days are left for the expiration of the current billing month, You will still be charged for the next month and the membership/subscription will be cancelled from the month after. There will be no partial refunds and Your membership/subscription will remain activated for the remainder of the billing month.

The fixed number of washes that the member/subscriber is entitled to under the membership/subscription model can be used for a single Vehicle alone and hence, You must register the Vehicle for which You plan to avail the washes offered under the membership/subscription model. If You are found to be using multiple Vehicles under the membership/subscription model, You will be charged for the washes availed for Vehicles, other than the registered Vehicles at the applicable retail price.

Your car is identified by Us by the license place and hence, if the license plate is changed, You are required to update the same with Us either by coming to one of Our Service Centres or by sending a message on WhatsApp from the registered mobile number or by sending an email to Us at info@blueverse.ae.

The membership/subscription cannot be combined with other offers, discounts, pre-paid washes or gift cards. We reserve the right to update the prices of the membership/subscription with a prior 30 (thirty) days’ notice issued via WhatsApp or e-mail or also through posting the same at our Service Centre(s). By becoming a member/subscriber, You agree to be charged the renewal amount each month on the billing date.

Governing Law and Jurisdiction:

These Terms & Conditions shall be construed in accordance with the Laws of United Arab Emirates and the appropriate Courts at Dubai shall have exclusive jurisdiction in respect of any dispute arising out of or in relation to these Terms & Conditions.

Change to Terms:

We reserve the right to amend, modify, or update these Terms & Conditions at any time, without prior notice. Your continued use of the Platform and availment of the Services shall be deemed to be an acceptance of such amended, modified or updated Terms & Conditions.

Severability:

If any provision of these Terms and Conditions is held to be unlawful, void, or for any reason unenforceable under the laws of the UAE, such illegality or unenforceability shall leave the remainder of these Terms & Conditions, including the term or condition affected, to the fullest extent permitted by law, unaffected and valid. We shall replace such illegal or unenforceable provision with a valid and enforceable provision that comes closest and best reflects the intention in a legal and enforceable manner with respect to the invalid or unenforceable provision.

The Company will issue all correspondence to You  on Your registered mobile number or by general notification on the Website. In the event, You wish to issue notice to the Company pursuant to these Terms & Conditions, You shall send it via email on info@blueverse.ae           

Disclaimer: 

1. You are responsible for making sure Your Vehicle is in an acceptable condition to be washed or cleaned. If there is any doubt for You to ascertain if the Vehicle can be washed or cleaned, You are responsible for asking Our staff prior to utilizing the Services. You are responsible for operating Your Vehicle in a safe and proper manner and in accordance with all verbal or written instructions, if any, while on the premises of the Service Centre(s), including, without limitation, properly loading Your Vehicle on to the conveyor belt and placing Your Vehicle in neutral, and confirming that it is in neutral prior to reaching the end of the conveyor belt. You acknowledge that You are responsible for any damage or injury caused to the car wash tunnel or equipment. If You do not know how to properly load Your Vehicle on the conveyor belt, or if You have any other questions or concerns about how to operate Your Vehicle safely or properly through the car wash or utilize the Services, You should ask prior to utilizing the Services. You accept all risk of, and You agree to not hold the Company and its shareholders, directors, officers, employees, staff and agents, harmless for, any injury to Yourself or the occupants of Your Vehicle and any damage to Your Vehicle(s) resulting from the actions of Yourself or another customer or guest, including, without limitation, another customer’s failure to operate his or her vehicle safely and in accordance with all verbal or written instructions.
2. Services, pricing, and promotions may vary by location. Not all Services offered at one Service Centre may be available at each Service Centre. We recommend contacting the relevant Service Centre to confirm available Services and pricing before visiting.
3. The Platform and the Services are provided “as is” and “as available” with all faults and without warranty of any kind (express or implied). We do not guarantee, represent, or warrant that all Services will be available at all Service Centre(s).
4. We do not represent that the Services are suitable for Your Vehicle. We specifically disclaim liability for, and You assume the risk for, damage to Your Vehicle or injuries related to or arising from any of the following:
5. Vehicles 15 years or older or over 100,000 miles;
6. Vehicles with less than five inches (5”) of ground clearance or vehicles that are greater than seven-feet, two-inches (7’ 2”) in height;
7. All non-factory installed accessories;
8. Driver negligence;
9. Plastic parts, e.g., hubcaps, mirrors, trim, taillights, headlights, light bars, etc.;
10. Antennas, satellite radio, aftermarket accessories, etc.;
11. Aftermarket racks of any kind (roof, bike, hitch, etc.);
12. Parts of logos attached with tape or adhesive, press fit or snap on license plate frames;
13. All loose items (trims, wipers, mirrors, rails, etc.);
14. Aftermarket wheels or extended valve stems;
15. Non-standard or non-factory equipment, e.g., custom tires/rims, running boards, bug shield, etc;
16. Pinstriping graphics, painted plastic, repaints;
17. Previous bodywork, pre-existing or unforeseen conditions or defects;
18. Existing chips in glass that may expand;
19. Moon roofs, sunroofs, or glass;
20. Items left in or around the vehicle;
21. Previous paint defects (surface marring, halo-scratches, holograms, etching);
22. Electric mirrors, running boards, and antennas not folded in or retracted;
23. Antennas of any kind including “fin style” (Recommend removing antennas);
24. Windshield wipers & Automatic Windshield wipers left on;
25. Vehicle without warranties;
26. Failure to follow car wash attendant directions and car wash traffic signs/signals;
27. Articles/belongings left in the Vehicle during performance of the Services.
    
    

Annexure A

List of services

1. Express Wash – body wash with brushes and brushless performed in a conveyor based tunnel, with different packages and offerings.
2. Manual Wash – perfomed in manual wash bays with manual operation of highpressure water nossle and other equipments and hand cleaning with a range of offerings.
3. RoBOT AI WASH – A high pressure wash Performed by a SET of AI integrated robots.
4. Detailing – That includes detailing exterior and interior of the car with various chemicals along with coatings, wrappings, tinting and body work services.
